General Terms and Conditions (GTC)

A. Orban Travel, operating through the website www.utopiasignaturetravel.com, hereinafter referred to as “Utopia Signature Travel”.

1. Scope of Application

These General Terms and Conditions (“GTC”) govern all contracts, services, and offers provided by Utopia Signature Travel, headquartered in 6204 Sempach, Switzerland, in relation to the planning, arrangement, booking, and organization of individual and bespoke travel for domestic and international clients.

By accessing our website and/or using any of our services, you expressly accept these GTC.

2. Subject Matter of the Contract

Utopia Signature Travel provides services relating to the arrangement, design, and organization of individual and group travel.
Contracts for travel services are concluded either:

• directly between the customer and the respective service provider (e.g., hotel, airline, tour operator), or

• between the customer and Utopia Signature Travel as the tour operator, where expressly agreed.

3. Formation of Contract

A binding contract is established upon the issuance of a written or electronic booking confirmation by Utopia Signature Travel.
Any offers presented on the website or in presentations are non-binding and subject to change.

4. Contracts with Third-Party Tour Operators

Where Utopia Signature Travel arranges travel services provided by third parties, the performance of those services is governed solely by the terms and conditions of the respective tour operator or service provider.
Utopia Signature Travel accepts no responsibility for the proper delivery of such third-party services.

The applicable terms and conditions of the respective provider will be communicated to the customer at the time of booking and form an integral part of the contract.

5. Services and Prices

The scope of services contractually agreed upon is determined by the relevant travel description and the booking confirmation.

Price adjustments after the conclusion of the contract may occur due to exchange rate fluctuations, governmental charges, or official fees, provided such adjustments are legally permissible.

6. Payment Terms

Upon booking a service from Utopia Signature Travel, a deposit becomes due. The amount and due date of the deposit shall be agreed individually for each trip.

The remaining balance of the total price must be paid by the deadline stated in the booking confirmation.

Payments may be made via bank transfer or through the payment methods offered on the website.

For customers residing outside Switzerland, Utopia Signature Travel reserves the right to require payment of the full amount prior to confirming the booking and issuing travel documents.

Failure to make payment may result in reminders, debt collection proceedings, or cancellation of the booking.

7. Travel Documents

Travel documents shall be delivered to the customer in due time before departure.
The customer is responsible for immediately verifying the accuracy of all information (e.g., name, travel dates) and must report any discrepancies without delay.

Utopia Signature Travel shall not be liable for errors that were evident to the customer and not reported.

8. Cancellation and Termination

Cancellation and termination conditions, including any applicable refunds, are defined individually in each travel offer and constitute a binding part of the respective booking agreement.

Customers are strongly advised to take out travel cancellation and interruption insurance.

9. Changes and Rebookings

Changes to bookings or rebookings are only possible in exceptional cases and require prior consultation with all involved service providers.
Additional fees or price adjustments may apply.

10. Complaints and Customer Support

Complaints relating to Utopia Signature Travel’s brokerage services must be submitted in writing without undue delay, and in any event within 7 days of becoming aware of the issue.

For complaints relating to the travel services themselves, the respective tour operator is solely responsible.

11. Liability

Utopia Signature Travel is liable, within the limits of applicable law, for the careful selection, advice, and arrangement of the services offered.

Utopia Signature Travel shall not be liable for:

• service disruptions caused by third parties (e.g., airlines, hotels);

• events of force majeure (including natural disasters, political unrest, strikes);

• delays, changes, or cancellations of services outside its control.

To the extent permitted by law, liability for slight negligence is excluded.
In such cases, Utopia Signature Travel is liable only for direct damages and not for indirect or consequential losses.

12. Entry, Visa, and Health Requirements

Customers are solely responsible for complying with applicable entry, visa, customs, and health regulations.

Utopia Signature Travel provides information to the best of its knowledge but cannot guarantee its timeliness, completeness, or accuracy.

No liability shall be accepted for disruptions resulting from failure to comply with such requirements.

13. Data Protection

Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

Customer data is used exclusively for contract performance and to fulfil legal obligations.
Data will only be shared with third parties to the extent necessary for the provision of the booked travel services.

14. Governing Law and Jurisdiction

The contractual relationship between Utopia Signature Travel and the customer is governed exclusively by Swiss law.

The exclusive place of jurisdiction is Sempach, Switzerland, unless mandatory statutory provisions specify another venue.

15. Severability Clause

Should any provision of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected.
The parties shall agree to a replacement provision that reflects as closely as possible the intended meaning and purpose of the invalid provision.
